2.         Use of “Cookies":

When you visit our website, information in the form of "cookies" is temporarily or permanently stored on your computer/device, which automatically recognizes you the next time you visit our website.

“Cookies” are small text files, which allow, e.g., the adaptation of an application to the visitor’s interests. If you do not want “cookies” to be stored by MicroSys, you are asked to set the end device to delete these “cookies”, to block all or certain “cookies” or to issue a warning before any “cookies” are stored.

You can find further functions of the cookies used by us in paragraph 5.

3.         Automatically Recorded Non-Personal Data:

When you visit our website, the following data, which your Internet browser transmits to us or our web hoster (so-called server log files) will be collected as standard by our web server or the web hoster used by us, and will be stored in a log file:

  • name of the requested file
  • IP addresses
  • date and time of the server request
  • transferred data volume
  • report whether the request was successful

The server log files contain IP addresses or other data that enable an assignment to a user. This could be the case, for example, if the link to the website from which the user accesses the website or the link to the website to which the user switches contains personal data. The data is stored in the log files of our webhoster.

This data is not stored together with other personal data of the user. The data will be deleted as soon as they are no longer necessary to achieve the purpose for which they were collected. If the data is stored in log files, this is the case with our web host after 7 days at the latest. MicroSys or the web host used by us processes this information on the basis of our legitimate interest pursuant to Art. 6 Para. 1 S. 1 lit. f GDPR in connection with. Art. 28 GDPR (conclusion of a contract for order processing) in order to determine and improve the attractiveness, the services and the contents of the Internet presence or to guarantee a secure provision of our online offer.

4.         Processing of personal data

4.1      Personal data is only collected by MicroSys if you actively communicate it to us, e.g. by creating a customer account, by ordering our newsletter or via our contact form. You have the right to object at any time to the use of this data for the respective purpose for the future. See also paragraph 10.

4.2      The personal data collected from you will only be used for the purpose for which you gave it to us or for the use and forwarding of which you gave us your consent. After completion of the contractual relationship the user data shall only be stored as long as is required on the basis of fiscal and commercial law retention periods. On expiry of these periods the data will, however, be deleted, unless you have given your express consent to its further or different use. You can also assert rights during the retention periods, such as blocking your data. See paragraph 10.

4.3      Insofar as we obtain your consent for the processing of personal data, Art. 6 para. 1 lit. a EU Data Protection Ordinance (GDPR) serves as the legal basis for the processing of personal data.
In the processing of personal data required to fulfil a contract with you, Art. 6 para. 1 lit. b GDPR serves as the legal basis. This also applies to processing operations that are necessary to carry out pre-contractual measures.

Insofar as the processing of personal data is required to fulfil a legal obligation to which our company is subject, Art. 6 para. 1 lit. c GDPR serves as the legal basis.

In the event that the vital interests of the data subject or another natural person require the processing of personal data, Article 6(1)(d) GDPR serves as the legal basis.
If the processing is necessary to safeguard a legitimate interest of our company or a third party and your interests, fundamental rights and freedoms do not prevail, Art. 6 para. 1 letter f GDPR serves as the legal basis for the processing.

Personal data will be deleted or blocked as soon as the purpose of storage is no longer valid. After the end of the contractual relationship, all customer data will only be stored as long as the storage is required by statutory retention periods (e.g. under tax and commercial law). After expiry of these periods the data will be deleted, unless you have expressly consented to their further use.

4.4       There will be no transfer of your personal data to third parties for purposes other than those listed below. We will only pass on your personal data to third parties if:

  • you have given your express consent pursuant to Art. 6 para. 1 lit. a) GDPR,
  • the disclosure pursuant to Art. 6 para. 1 lit. f) GDPR is necessary to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
  • in the event that a legal obligation exists for the transfer pursuant to Art. 6 para. 1 lit. c) GDPR, and
  • this is legally permissible and required by Art. 6 Para. 1 lit. b) GDPR for the processing of contractual relationships with you.

The collection or transfer of personal data to state institutions and authorities only takes place within the framework of mandatory national legal provisions.

Your data will be forwarded to service providers or group companies for the processing of a contractual relationship (e.g. provision of a service or sale of goods) - depending on the type of specific contractual relationship - which we regularly use to provide the service or for contract processing. To the extent required by law, we will conclude an agreement with these service providers for order processing (Art. 28 GDPR) in order to ensure data processing only within our instructions under appropriate data security measures.

4.5      The employees and subcontractors of MicroSys are contractually bound to secrecy and the observance of data secrecy.

5.         Use of web tracking:

5.1      Use of webtracking-services of Google LLC:

This website uses the Google Analytics service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States, a subsidiary of Alphabet Inc, hereinafter referred to as "Google", to optimize our Internet presence and improve our advertising measures.

This procedure serves to evaluate the use of the Internet presence by the users, to compile reports on the website activities for MicroSys and to provide further services connected with the use of the Internet presence as well as to improve our Internet presence and our customer approach and is therefore in our legitimate interest according to Art. 6 para. 1 lit. f) of the GDPR.

Google is member of EU-US Privacy Shield which requires minimum standards for the protection of personal data of Europeans whose data was stored or processed in the USA.

For more information about Google's data processing, please read Google's privacy policy.

5.2      Google Analytics:

Microsys uses Google Analytics to optimize its website. This procedure serves to evaluate the use of the website by the users, to compile reports about the website activities for Microsys and to provide further services connected with the use of the website.

With the help of the _anonymizelp () extension, a shortened IP address is processed further.

By using our website, the user agrees to the processing of the data collected about him/her by Google for the use of Google Analytics.

Google may pass on the stored information to third parties if required by law or if third parties process this data on behalf of Google.

This web analysis service from Google Inc. also stores cookies on your computer in accordance with section 2. The information generated in this way is transmitted to and stored on a Google server in the USA. If the storage of cookies is not desired, please follow the instructions in paragraph 2.

Alternatively, the deactivation add-on from Google Analytics can be used by the user under the URL tools.google.com/dlpage/gaoptout. Please note that this is not available for every internet browser. In addition, you can also install an opt-out cookie via this link on your device, in particular for browsers of mobile devices, so that the collection of data by Google Analytics on our website will be prevented in the future. Please note that when deleting cookies on your mobile device, you must also reinstall the opt-out cookie.

5.3      Use of Matomo:

This website uses the Web analytics service Matomo to analyze and regularly improve the use of our website. On the collected statistics, we can improve our offer and for you as a user more interesting and easy to use design. Legal basis for the use of Matomo is article 6 section 1 f GDPR.

For this evaluation cookies (please see also section 3) on your computer are saved. We store the information so collected exclusively on our server in Germany, and the data will not be disclosed to third parties. You can set the evaluation by deleting existing cookies and prevent the storage of cookies. If you prevent the storage of cookies, we point out that you perhaps cannot fully, use this Web site.

If details of our Web site are accessed, following data is stored in this context:

-  two bytes of the IP address of the user's calling system
-  the accessed webpage
-  referrer
-  the subpages which are accessed from the accessed web site
-  the dwell time on the Web site
-  the frequency of the call of the Web site

By the setting in your browser, you can prevent the storage of cookies. The prevention of the use of Matomo is possible by removing the following hook and enable the opt-out-plug-in:

You are not being tracked since your browser is reporting that you do not want to. This is a setting of your browser so you won't be able to opt-in until you disable the 'Do Not Track' feature.

Matomo is used with the extension "AnonymizeIP". Thus, IP addresses are processed further shortened, a direct connection to a person is therefore excluded. The IP address sent by using Matomo from your browser is not merged with other information we collect. Your IP addresses are not completely saved, because 2 bytes of the IP address are masked (example: 192.168.xxx.xxx). In this way, a mapping of the abbreviated IP address to the calling machine is no longer possible.

The data will be deleted when it is no longer needed for the purposes of our recording. In our case, it is deleted after 7 days.

The program Matomo is an open-source project. To information of third-party privacy policy, see Matomo.org/privacy/policy.

6.        E-mail contact and contact forms

There is a contact form available on our website, which can be used for electronic contact. If a user accepts this possibility, the data entered in the input mask will be transmitted to us and stored with the content of the message. This data is:

  • Name
  • Subject
  • E-Mail

At the time of sending your message via one of our contact forms, the following data will also be stored:

  • the IP address of the user
  • the date and time of registration

You can contact us via our provided e-mail address (available at our impressum or contact data). In this case, the personal data transmitted with the e-mail will be stored.

In this context, the respective data will not be passed on to third parties unless it is necessary to pursue our claims or there is a legal obligation in accordance with Art. 6 Para. 1 lit. c GDPR or you have consented to this. Your data will only be used for the processing of your request or the corresponding conversation. The processing of personal data from the input mask of the contact form or an e-mail sent to us serves us solely to process the establishment of contact. In the event of contact, this also constitutes the necessary legitimate interest in the processing of the data.

Other personal data processed during the sending process serve to prevent misuse of the contact form and to ensure the security of our information technology systems.

7.         Links to other websites and integration of content

Our website may contain links to other websites. MicroSys is not responsible for their privacy statements or content.

8.          Integration of third-party content

8.1.
     YouTube

We use on our website from time to time on the basis of our legitimate interests (Art. 6 par. 1 lit. f) GDPR) content or service offers of YouTube LLC, 901 Cherry Ave. San Bruno, California, CA 94066, United States (hereinafter referred to as "YouTube") to incorporate video content on our website using a plugin. YouTube is a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States, a subsidiary of Alphabet Inc. If you want to play the embedded videos using this plugin (by clicking the play button), your IP address is sent to YouTube, as YouTube cannot send the video content to your browser without the IP address. The IP address is therefore required for the display. Furthermore, the subpage of our website you have visited is transmitted to the YouTube server. If you are logged into your YouTube account as a YouTube member, you will also allow YouTube to associate your usage behavior directly with your personal profile when playing our videos. To prevent this assignment, log out of your YouTube profile before playing our video content. For more information about YouTube's data processing, please refer to YouTube's privacy policy.

8.2      Google Maps

We use Google Maps to display interactive maps and to create route maps on basis of our legitimate interest (Art. 6 par. 1 lit. f DSGVO). Google processes your personal data in the USA and is subject to the EU-US Privacy Shield Agreement.

Each time Google Maps is accessed, Google sets a cookie in accordance to section 2 in order to process user settings and data when displaying the page on which the Google Maps component is integrated. In particular, Google receives information that you have visited the corresponding subpage of our website. This cookie is not deleted when you close your browser, but expires after a certain period of time, unless you delete it manually. If you do not agree to this processing of your data, it is possible to deactivate the Google Maps service and thus prevent the transfer of data to Google. Therefore, you must deactivate the JavaScript function of your browser. However, in this case you will not be able to use Google Maps or only to a limited extent.

If you are logged into your Google account during your use of Google Maps, the above mentioned data will be directly linked to your Google account. If you want to avoid this, you'll have to close your Google Account before using the Google Maps features.

Google may store your data within user profiles and use them for purposes of advertising, market research and/or demand-oriented design of its services. According to Google, such analysis are carried out in particular to provide demand-oriented advertising and to inform other users about their activities on our website (even for users who are not logged in). You have the right to object to the creation of these user profiles, whereby you must contact Google to exercise this right. For more information about Google's handling of personal data, your rights towards Google and setting options to protect your privacy, please refer to GoogleÄs privacy policy: www.google.de/intl/de/policies/privacy

9. Surveys

From time to time, we ask existing customers, employees or other business contacts who have agreed to be contacted by e-mail to take part in surveys (e.g. on customer satisfaction). Participation in a survey is on a voluntary basis.
The scope of the data also depends on the information provided by the participant, particularly if the question is openly formulated. The following personal data may be processed:

  • IP address
  • User name, displayed name, e-mail address
  • Profile picture (if stored in Microsoft 365)
  • Preferred language
  • Status (if stored in Microsoft 365)
  • Date and time the questionnaire was opened
  • Date and time the response was sent
  • Information in the survey: This information is specific to the survey. The survey participant determines which data is transmitted when free text is entered in answer fields.

Anonymous participation: If a survey participant takes part in a survey anonymously, the data they enter in the corresponding survey form will be transmitted to us and stored without their name or contact address. The response does not contain any contact information and cannot be traced by us. In this case, only the usage data collected as a visitor to our website or as part of the technical provision of the survey (so-called "log files", in particular the IP address) are recorded.

The legal basis for the processing of the data transmitted to us in the course of sending a survey is our legitimate interest in optimising our products and services and market research, as well as in the associated technical implementation of the survey or preventing misuse of the survey form and ensuring the security of our information technology systems (Art. 6 para. 1 lit. f GDPR), unless we ask the participant for their consent in accordance with Art. 6 para. 1 lit. a GDPR and we have this consent. In individual cases, a survey may also serve the fulfilment of a contract (Art. 6 para. 1 lit. b GDPR).

On the basis of our legitimate interests (Art. 6 para. 1 lit. f GDPR) in conjunction with Art. 28 GDPR, we use Microsoft Forms for our online-based surveys, to send the survey emails and for the technical implementation of the surveys. Microsoft Forms is a service of Microsoft Corporation, provided in Europe by Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, D18 P521, Ireland. In this respect, Microsoft acts as our processor. Microsoft cookies are used on the survey page to provide the Microsoft Forms service. Insofar as "Microsoft Forms" independently processes personal data or uses cookies, Microsoft is responsible for data processing. Further information on data protection at Microsoft can be found at privacy.microsoft.com/de-de/privacystatement.Further information on data protection in the context of Microsoft Forms and on Microsoft's other processing purposes can be found at: support.microsoft.com/de-de/office/sicherheit-und-datenschutz-in-microsoft-forms-7e57f9ba-4aeb-4b1b-9e21-b75318532cd9

Survey data will be deleted as soon as the survey has been completed and analysed. The participant has the option, at any time, to revoke any consent they have given to the processing of their personal data for the purpose of conducting surveys. Withdrawal or non-granting of consent does not result in any disadvantages.

10.         Information on user rights

Upon request, MicroSys will inform you in writing as soon as possible whether and which of your personal data is stored by us. If, despite our efforts to ensure that the data is correct and up to date, incorrect data is stored, it will be corrected by us upon request.

In addition to this right to correction, you also have the right to block and delete the personal data we have collected if necessary. It may be that we cannot immediately comply with every request for cancellation for legal reasons, especially due to tax or commercial law regulations, or for reasons of smooth contract execution. In this case we will contact you and discuss with you to what extent we can block the data for further processing and from which point in time a final deletion is possible.

In addition, you have the right to request that we transmit the data to you as a structured, standard and machine-readable format or, at your express request forward it to a third party.

You may object to the use of your data for future purposes, i.e. for purposes other than the execution of the contract or processing in our legitimate interest. In particular, you may object to the use of your data for advertising purposes. You also have the right to request a restriction of data use for certain purposes.

If you have any further questions regarding the collection, processing and use of personal data or the correction, deletion or blocking of such data, please contact MicroSys. The contact address can be found in paragraph 1.

11.         Data security

We use the most common SSL (Secure Socket Layer) method in connection with the highest level of encryption supported by your browser. This is usually 256-bit encryption. If your browser does not support 256-bit encryption, use 128-bit v3 technology instead.

Whether a single page of our website is transmitted in encrypted form is indicated by the closed display of the key or lock symbol in the lower status bar of your browser.

We also use suitable technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorised access by third parties. Our security measures are continuously being improved in line with technological developments.
